In a disappointing 113 to 97 vote, Cyfair nurses chose to remain organized under the NNOC/CNA

Decertification Petition Filed Against the CNA

Congratulations UB144!  We have successfully obtained more than enough signatures to file a petition with the National Labor Relations Board for a union decertification election.  It was filed yesterday at approximately 2:30pm and the petitioner, Marissa Cuellar, RN will be notified by the Board when the parties have been informed.  We would like to inform all our nurses to anticipate the upcoming actions of the California Nurses Association as soon as they find out about this petition.  First, be prepared to see them file numerous "ULP's" (unfair labor practice) charges against our hospital.  This is a tactic they utilize frequently in order to suspend or block elections.  They will beef up their support systems with more organizers as you have recently witnessed already. They will make phone calls and start pressuring our nurses again just as they did during their campaign. If you ever feel threatened or harassed by any union organizer or union supporter be sure to document names, times, circumstances, location as well as exactly what was said and or done. Report this to your supervisor and human resources ASAP.  You will see more flyers and propaganda everywhere so read between the lines and help people see through the lies.  Contact any UB144 member for any questions @ ub144@yahoo.com

During the month of April, members of UB144 are collecting decertification signatures.  Marissa Cuellar, RN is our petitioner and all signed cards will be given to her. We must collect a minimum of 30% signatures to prove to the NLRB that there is enough interest at CyFair to petition for a private ballot election.  If you are interested in assisting us in this endeavor, please notify Marissa on IMC3, during your break time. Remember, this is and must remain an employee driven campaign. Do not have any discussion with management regarding this campaign as they must not be involved in any way, shape or form. Thank you kindly for your assistance in our attempt to get our voice back.

FYI: Regarding Membership Drive

  Due to numerous questions by our Registered Nursing staff regarding Union membership, the following links have been compiled to assist you in finding those answers.  The most commonly asked question currently floating around is “Do I have to join the union since they represent me?” The answer is simply NO. Even if you signed an interest card during the campaign, voted for the union or attended any of their meetings, you still do not have to join. The CNA has no authority to take union dues out of your paycheck unless you sign authorization giving them the ability to do so. If you do not join the union you will still be represented by them and receive all the same benefits as union members without paying dues. This is commonly known as a “Free Ride”. You will not be able to vote on certain matters, like whether to strike or not. On that note, if there is a strike and you don’t participate, you can’t be fined because you are not a member.  If you feel pressured, coerced, intimidated in anyway to join, report it to your immediate supervisor, human resources, or better yet, the National Labor Relations Board.   FYI: November 2008

The nurses at the Cedar Campus of the Community Medical Centers Health System in Fresno voted to decertify CNA. The nurses in this bargaining unit had been attempting for over three years to get a decertification vote. The CNA however, through various unfair labor practice charges and other procedural maneuvers, had blocked the election from going forward. This decertification follows a number of other difficulties that CNA has experienced recently in California including the following:

Decertification for the CNA bargaining unit at the Scripps Health System, Encinitas Campus early 2008 - CNA objections are still pending to such election.

CNA withdrawal as bargaining representative for the nurses at the Inland Valley Medical Center in Temecula. CNA withdrew as the bargaining representative for the Registered Nurses at this medical center before a NLRB secret ballot conducted decertification vote was to occur. CNA had blocked an earlier attempt of the nurses at that medical facility to decertify the union.

CNA was rejected in an NLRB secret ballot conducted election by 125 votes by the nurses at St. Agnes medical Center in Fresno in May of 2008. CNA Election Objections are pending regarding that election - such objections will be heard by an NLRB Administrative Law Judge the week of Nov. 17th
